These terms govern use of the mobile application "Memivo" (the "App"), provided by Pragpath Studio – Ardalan Ebrahimi, sole proprietorship, 14052 Berlin, Germany ("we"). The version in force at the time of use applies.
Memivo is an app for learning German vocabulary (levels A1–B1). It offers free features and an optional paid "Premium" membership. Premium removes ads and lifts the daily limit on AI-generated word explanations. Pronunciation audio is available to all users at no charge.
The App is distributed through Google Play. Purchases and subscriptions are processed exclusively via Google Play Billing, to which Google's terms additionally apply. The subscription contract is concluded upon confirmation of the purchase in Google Play.
Applicable prices are shown in Google Play before purchase. Subscriptions renew automatically for the chosen period unless cancelled in time. Management and cancellation are done in the Google Play account's subscription settings.
Consumers generally have a 14-day right of withdrawal. For digital content, this right expires once performance has begun with the consumer's express consent and acknowledgement that the right of withdrawal is thereby lost. Refunds are otherwise governed by Google Play's policies.
The App may only be used in accordance with applicable law and these terms. Misuse, circumventing technical restrictions, or automated scraping of content is not permitted.
We aim for high availability but do not warrant any specific uptime. Maintenance, outages, or changes to the feature set may occur.
We are liable without limitation for intent and gross negligence, under the Product Liability Act, and for injury to life, body or health. For ordinary negligence we are liable only for breach of a material contractual duty, limited to foreseeable, contract-typical damage. Learning content is prepared with care, but no guarantee is given for the completeness or accuracy of every individual entry.
We may amend these terms with effect for the future where there is a valid reason and users are not unreasonably disadvantaged. The current version is always available at this address.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the consumer's country of residence remain unaffected. Should any provision be invalid, the remaining provisions remain effective.
